  1. How do you decide whether to place an injured worker (workers compensation) on FMLA or Cobra?
  2. Did you know the courts have ruled there are ways to prevent punitive damages if an employee sues you for sexual harassment?
  3. Can you document your OSHA training and show you are using the new forms effective January 1, 2004?
  4. Are your supervisors aware that they have personal liability if they violate an employees FMLA rights? Have they been trained in FMLA and understand it is their responsibility (not employee's duty) to recognize a FMLA qualifying event.
  5. Is your Section 125 Plan compliant with the rules on deducting health insurance premiums from employee checks? Do you deduct in same month of billing or in advance? How does an employee pay for health insurance when they are on disability?
  6. Are your workers compensation reserves on employee claims reviewed closely at the proper time before your experience modification is calculated?
  7. Does your employee manual comply with government regulations and has it been updated recently?
  8. Does your FMLA policy state that the 12-month period is rolling and looking backwards? If not did you know an employee could take off 6 months with a guaranteed job and equivalent pay when he returns?
  9. Can you prove that you sent a Cobra notice and HIPPA notice to a new employee's house when their divorced spouse two years later sues because she wasn't notified of her Cobra Benefits and HIPPA Options?
  10. Are Cobra notices sent to employees who are on leave of absence, disability or workers compensation?
